NEW TECHNICAL CONDITIONS FOR PLANNED BUILDING PROJECTS

On 1 April 2024, an amendment to the regulation on the technical conditions to be met by buildings and their location will come into force. The changes being introduced are important from the point of view of future investments, especially those of a residential nature. The changes will apply to construction projects for which a building permit has been applied for or a notification of construction has been submitted after 1 April 2024. Therefore, it is high time to take a closer look at the significant modifications to the requirements in order to prepare for adequate investment planning.

Worth noting, for example, is the new obligation to designate a storage room for bicycles and prams in multi-family residential buildings. There will also be a requirement to provide for a fenced-off playground with minimum surface area.

The new regulations impose a requirement to ensure the privacy of flats with balconies. From 1 April 2024, a partition of the indicated height and width will need to be provided between balconies. Some changes will also apply to parking spaces and to maintaining the necessary distances between residential buildings.

The amendment also partially affects commercial and industrial construction. In this respect, the changes concern the required areas of premises or the necessary distances from residential buildings. In principle, these changes are aimed at combating pathological developments, in Polish referred to as “patodeweloperka” and improving the housing conditions of future property buyers. However, one should bear in mind that the increased technical requirements will affect the majority of projects, not only residential ones. In addition, the effect of the enacted amendment will most likely be an increase in the cost of the construction itself, which investors are already pointing out.
